ZivoAI Terms of Service

These Terms of Service ("Terms") govern your access to and use of ZivoAI's website and services. By using ZivoAI, you agree to these Terms.

1. About ZivoAI

ZivoAI provides AI-powered receptionist services for medical spas and service businesses. Features may include inbound call answering, appointment booking, deposit collection, upselling, structured lead intake, and dispatch-style notifications to the business owner or manager. Specific features and availability may vary by plan and configuration.

2. Subscription & Billing

  • Plans are billed monthly through Stripe
  • 7-day free trial included — you won't be charged until day 8
  • Cancel anytime — no contracts, no cancellation fees
  • Setup takes approximately 1 hour with our team

3. Your Responsibilities

  • Provide accurate business information (services, pricing, availability)
  • Keep your calendar updated if using calendar integration
  • Ensure you have the right to forward your business phone line to our service
  • Must be 18+ and authorized to act on behalf of your business
  • Don't use ZivoAI for spam, fraud, harassment, or any illegal activity

4. Demo Requests & Communications

If you submit a demo request, you authorize ZivoAI to contact you using the information you provide (including by email or phone) to respond to your request and share demo details. You can opt out of communications by replying "STOP" to texts (if applicable) or emailing [email protected].

5. No Emergency Use

ZivoAI is not an emergency service. Do not use ZivoAI as a substitute for emergency response. Our AI can detect emergency keywords and flag them as urgent, but you must have your own emergency response procedures. For emergencies, contact 911.

6. Service Performance

Our goal is to improve call capture and response speed. Because outcomes depend on factors outside our control (call volume, staffing, pricing, service area, and customer decisions), we don't guarantee specific revenue, lead counts, or conversion results.

7. Service Availability

We strive for 99% uptime but don't guarantee uninterrupted service. We're not liable for missed calls, booking errors, or damages resulting from service interruptions. See our Refund Policy for service credit details.

8. Call Recording

Call recording is disabled by default. If you enable it, you are responsible for complying with call recording laws in your area (some states require two-party consent).

9. Third-Party Services

ZivoAI relies on third-party tools and providers (e.g., Twilio for telephony, Stripe for payments, Supabase for data storage, Render for hosting, Google Calendar for scheduling). ZivoAI is not responsible for third-party services, their availability, or their terms.

10. Liability

ZivoAI is provided "as is." Our total liability is limited to the fees you've paid in the past 3 months. We're not liable for indirect, incidental, or consequential damages.

11. Cancellation & Refunds

Cancel anytime through your Stripe dashboard or by emailing us. See our Refund Policy for full details on refunds and service credits.

12. Termination

You can cancel anytime. We can terminate your account for violations of these terms or non-payment. Upon termination, your data will be deleted within 30 days.

13. Changes

We may update these Terms at any time. The "Last updated" date indicates when changes were made. Continued use after changes means you accept the updated Terms.

14. Governing Law

These terms are governed by the laws of Ontario, Canada.
